A grant of Probate is a court order which empowers the Executor to carry out the instructions in the deceased's will. This includes the distribution of the deceased's assets to his specified beneficiaries.
In the absence of a Will, an Administrator will be appointed by the court to administer the distribution of the deceased's estate. The Administrator is appointed based on the member of classes of beneficiaries under the Intestate Succession Act: the spouse; the children of the deceased; the parents; brothers and sisters; nephews and nieces; grandparents; and uncles and aunts.
